Eligibility: NBA #JrNBA Sweepstakes (“Sweepstakes”) is open only to individuals who are legal residents (natural persons only) and physically located in one (1) of the fifty (50) United States or the District of Columbia, and have reached the age of majority (at least eighteen (18) years of age) at the date and time of entry (“Entrant”). Employees, officers, directors, representatives and agents of NBA Properties, Inc. (“NBAP” or “Sponsor”), NBA Media Ventures, LLC (“NBAMV”), the National Basketball Association (“NBA”) and its member teams, NBA TV, LLC (“NBATV”) (NBA, NBAMV, NBATV and NBAP collectively referred to as the “NBA Entities”), LEJ Sports Group and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, and advertising/promotion agencies (collectively with Sponsor, the “Released Parties”), and the immediate family members (i.e., parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not legally related, are not eligible to participate or win a prize. Void where prohibited by law. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering, you understand that you are providing your information to the Sponsor and not Instagram. The information you provide as detailed below will only be used for Sweepstakes purposes.
Promotion Period: Sweepstakes begins at 12:00:01PM Eastern Time (“ET”) on 2/8/21 and ends at 11:59:59PM ET on 8/8/21 (“Promotion Period”).
How to Enter: During the Promotion Period follow the following steps to earn one entry into the respective drawing: 1) Follow @JrNBA on Instagram; 2) Look for a JrNBA Promotional Post (“Post”); and 3) In the comments section of the Post “Tag” one (1) friend in accordance with instructions provided in the Post and use the hashtag #JrNBAEntry (collectively “Entry”). Your Instagram account must be public in order to be eligible for Entry. Entrants must have a personal relationship with the friends that they Tag in the comments section. Once you complete the above steps, you will receive one (1) Entry into the applicable prize drawing. Limit one (1) Entry per person/email address/Instagram account per Post. Entries received outside of the stated limitation will be void. Subsequent attempts made by the same individual to submit multiple Entries by using multiple or false contact information or otherwise may be disqualified. Message and data rates may apply if entrant enters Sweepstakes via mobile device.
Entry Criteria and Terms: Entries must be submitted by the authorized Instagram account holder at the time of entry. “Authorized Instagram account holder” is deemed as the natural person who is assigned to the Instagram account from which the entry was received. Instagram Posts must be posted by the close of the applicable Post to be eligible to be included in the applicable random drawing. If your Instagram account is private, your entry will NOT be eligible; you must change the setting on your account from private to public in order to submit an eligible entry. You must have a valid Instagram account and agree to the Instagram Terms of Use and the Instagram Data Policy and Cookies Policy in order to be eligible to enter. Registration on Instagram must be completed before an entry may be submitted. Instagram membership is free. NOTE: Sponsor may not receive entries from Instagram users with “private” account settings (i.e., user has set their Instagram account so that only people the user has approved can view their posts) due to the way Instagram operates its service. Sponsor, at its sole discretion, may accept a technically incorrect unique term. Messages not received by Sponsor will not be entered into the Sweepstakes. By including the hashtag “#JrNBAEntry” in the post, entrants are confirming their acceptance and agreement to these Official Rules. Entries must conform to the following:
• Post must meet the entry requirements listed above;
• Must be in English;
• Must not contain material that violates or infringes another’s rights, including, but not limited to, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
• Must be non-confidential and has been legally created (i.e., does not violate any laws or regulations in the making of the entry);
• Must be suitable for publication in a public forum (as determined by Sponsor in its sole discretion);
• Must not disparage Sponsor, Administrator or any other person or party affiliated with this Sweepstakes;
• Must not in any way mention, refer or otherwise allude to the name, logo or trademark of any entity, individual, product or brand other than those of Sponsor;
• Must not include personally identifiable information;
• Must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous (as determined by Sponsor at Sponsor’s sole discretion);
• Must not contain, facilitate, reference or use material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status or age (as determined by Sponsor at Sponsor’s sole discretion);
• Must not contain any viruses, spyware, malware or other malicious components that are designed to harm the functionality of a computer in any way; and
• Must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where entry is created.
Additional Entry Criteria and Terms: The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of Entry) to enter the Sweepstakes is prohibited and any Entry made through such means, and any Entry that is deemed to be ineligible (at Sponsor’s sole discretion and in accordance with these Official Rules) will be void. All Entries become the property of the Sponsor and will not be acknowledged or returned. In the event of a dispute as to the identity of an Entrant based on the Instagram username submitted, Entry will be awarded to the authorized account holder of the Instagram account from which said Entry was submitted provided such individual is eligible according to these Official Rules. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate or undelivered tweets, questions, answers, comments, Mentions, Follow requests, direct messages or Entries, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of direct messages, tweets, questions, answers, comments, mentions or Entries, the announcement of a prize, for any injury or damage to Entrant’s or any other person’s computer or other device relating to or resulting from participation in this Sweepstakes, or for printing, typographical, human or other errors appearing in these Official Rules or other Sweepstakes-related materials. The Sponsor reserve the right, in their sole discretion, to void any Entries or Follow requests of Entrants and disqualify such Entrants whom the Sponsor believe have attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes and/or who are in violation of these Official Rules.
ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING ANY PLATFORM) OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVE THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor’s sole and absolute discretion. The use of automated or similar devices, which subvert the entry process, including, but not limited to, Entries, submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Sweepstakes is prohibited and entries through such devices are void. Administrator’s designated database clock will be the official timekeeper for this Sweepstakes. Illegible and/or incomplete entries and entries submitted by Entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Those who do not follow all of the instructions or abide by these Official Rules or other instructions of Sponsor may be disqualified.
Sweepstakes Entry Rights: Entrants warrant and represent that Sponsor and their designees shall have, without limitation, the perpetual non-exclusive right and license worldwide to edit, adapt, modify, publish, exploit and use the Entry and/or entrant’s name/username in any way and in any and all media now known or hereinafter discovered or devised, world-wide for trade, advertising, promotional, public relations and/or other purposes as the Sponsor and/or its designees may determine without further permission from, or notification or consideration to Entrants or any third parties. Entrants further agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding.
Winner Selection/Odds: Potential winners will be selected in a random drawing from among all eligible Entries received for the applicable Post by Sponsor whose decisions will be final and binding in all matters relating to this Sweepstakes. Drawings will be conducted within one business day following the end time posted on the applicable Post. Non-winning Entries from one drawing will not carry forward to subsequent drawings. Odds of winning will depend on the total number of eligible Entries received for the applicable Post. Potential winners will be notified on Instagram via a reply comment and/or direct message. All notifications will be sent through the @JrNBA handle on Instagram and each respective winner must respond within two (2) days of the notification with their respective contact information. Potential prize winners are subject to eligibility verification and compliance with these Official Rules. Limit one (1) prize per person, per household and per e-mail address. The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant’s e-mail account to receive e-mail messages. The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information.
Prizes: (25) Prizes/One (1) Prize Per Post: One (1) Jr NBA Item designated by Sponsor. Approximate retail value (“ARV”) not to exceed=$40. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by Sponsor. All prize details are at Sponsor’s sole discretion. All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes are each winner’s sole responsibility. Sizing on prizing is at sole discretion of Sponsor.
Miscellaneous: By participating in this Sweepstakes, each Entrant unconditionally agrees to comply with and abide by these Official Rules, and the decisions of Sponsor, including the interpretation of these Official Rules and their exercise of discretion, which are final and binding in all respects. Failure to abide by these Official Rules may result in disqualification. No transfer, assignment, cash redemption, or substitution of prizes (or portion thereof) except by Sponsor, who reserve the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value (except as otherwise provided above), at their sole discretion. Prize winners may be required to execute and return a Prize Claim form and any other documents required by Sponsor within two (2) days of date of receipt of documents prior to being eligible to receive his/her prize. If any potential prize winner fails or refuses to sign and return such documents within the time period required by Sponsor or if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified and an alternate may be selected. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification and awarding of prize to an alternate winner, at Sponsor’s sole discretion and time permitting. By participating, entrants agree to be bound by these Official Rules and agree that: 1) Sponsor and its designees may use (unless prohibited by law) entrant’s name, city and state of residence, photograph, any oral or written statements, and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize and any related activity thereto or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to terminate this Sweepstakes (or portion thereof) for any reason, including should virus, bugs, worms, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or for any other reason and, in the case of termination, at its discretion, select the winner(s) for the drawing(s) at issue from eligible non-suspect Entries received for the applicable drawing(s) prior to the event that required such termination. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that: (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s law.
Entry Information and Sweepstakes Communications: As a condition of entering the Sweepstakes, each Entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules. Any information Entrants provide to Sponsor may be used to communicate with Entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list. The information provided by Entrants will be used pursuant to the NBA Entities’ privacy policy available at: http://www.nba.com/news/privacy_policy.html.
